Terms and Conditions of the Loyalty Card Program

1. The organizer of the program is Trading Company Kowalik K. Kowalik, D. Kowalik General Partnership, headquartered at 22 Słowiańska Street, 64-100 Leszno, registered in the Commercial Register maintained by the District Court in Poznań – Nowe Miasto and Wilda in Poznań, IX Economic Department of the National Court Register, under registration number KRS 0000081546.

2. The program is intended for individuals making purchases at Mensa Home brick-and-mortar stores and at the online store www.mensahome.eu.

3. The aim of the loyalty card program is to reward buyers for their purchases.

4. This document constitutes the basis for the operation of the loyalty card – defining the rights and obligations of its participants.

 

DEFINITIONS

PROGRAM – an organized system allowing the rewarding of its participants, outlining the rules for opening and maintaining program accounts called loyalty cards.

PARTICIPANT – a natural person who meets the requirements of these terms and conditions. They are registered in the program based on a completed form.

CARD – a plastic card bearing the Mensa Home logo, used as proof of participation in the program.

PARTICIPANT'S ACCOUNT – an individual account created under the user's data, where points will be accumulated.

REGISTRATION FORM – a registration form completed by the customer. ORGANIZER – Trading Company KOWALIK K. Kowalik, D. Kowalik General Partnership, headquartered at 22 Słowiańska Street, 64-100 Leszno.

BRICK-AND-MORTAR STORE – a physical store of the Mensa Home network within the territory of the Republic of Poland. The list of branches is included in the annex to these terms and conditions and on the website www.mensahome.eu in the "Our Stores" section.

ONLINE STORE – an online store operated at the address www.mensahomem.eu.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

POINTS – units of measurement in the program; awarded to participants in accordance with the rules specified in these terms and conditions.

TERMS AND CONDITIONS – these terms and conditions of the loyalty card.

GOODS – products offered for sale in brick-and-mortar stores and in the online store www.mensahome.eu.

 

GENERAL

1. The rules of participation in the program are governed by these terms and conditions.

2. Within the program, participants accumulate points for each purchase of goods in brick-and-mortar stores on the territory of the Republic of Poland and on the online store's website.

3. Employees of the Mensa Home network and their immediate family members cannot participate in the program.

4. The condition for receiving the card is completing the registration form available in brick-and-mortar stores or completing the registration form available on the online store's website after registering an account.

5. Points awarded in the program can only be used as specified in the terms and conditions.

6. These terms and conditions are considered accepted by the participant by signing the registration form available in brick-and-mortar stores or by joining the program through the website www.mensahome.eu.

7. The program organizer is not responsible for damages resulting from transactions made by unauthorized persons, including losses or theft of the card.

 

PARTICIPATION

1. A participant may be a legal adult who has registered in the program based on a completed registration form.

2. Participation in the program is free and voluntary;

3. A person joining the program:

- has familiarized themselves with these terms and conditions;

- voluntarily agrees to the collection and processing of personal data by the organizer.

4. Only one card is assigned to the participant's email address and phone number.

5. The loyalty card is valid in all brick-and-mortar stores and on the online store www.mensahome.eu.

6. In the case of registration at brick-and-mortar stores, the registration form should be completed fully, legibly, truthfully, and submitted to the store employee.

7. The organizer will accept a form that has been completed fully, legibly, truthfully, and submitted to a brick-and-mortar store employee.

8. The organizer may reject a registration application, especially if it is incomplete or incorrectly filled out.

9. The card is sent by Polish Post to the address indicated in the form. Cards are not sent abroad.

10. If the participant has filled out the form at a brick-and-mortar store, the card will be automatically linked to their account on the online store based on their email address.

11. The participant's account may be automatically blocked if the participant:

- provided false personal information;

- does not comply with these terms and conditions.

12. If points on the participant's account have been accrued or used improperly, the organizer will have the right to invalidate part or all of the accrued points, and the participant will be informed about it.

13. When the participant's account is blocked, all accumulated points become void.

14. Points are valid for 12 months from the date of their accrual; after this period, points from a specific transaction will be deleted, but this does not affect points accrued from subsequent transactions.

15. A participant can opt out of the program at any time. Resignation can be made by:

- submitting a relevant statement containing the participant's signature at any brick-and-mortar store;

- sending an email message indicating the intention to resign from the program to the email address administrator@mensahome.eu;

- sending a statement to the address: Mensa Home at 49 Balonowa Street, 64-100 Leszno.

 

CARD

1. The card is the property of the program organizer.

2. The card is a discount card with privileges arising from membership in the program.

3. The card is not a payment, credit, or debit card.

4. The card is issued indefinitely.

5. The card is provided to the participant free of charge.

6. In the event of loss or damage to the card, the participant should submit a written application to any brick-and-mortar store or send a message to the email address administrator@mensahome.eu to block the card. The participant will be informed in detail about the process of obtaining a new card.

 

GENERAL RULES OF POINT ACCUMULATION

1. From the moment of receiving the card, a participant registered in the program can collect points according to the rules specified in the terms and conditions.

2. By joining the program and consenting to receive commercial information electronically at the provided email address, the participant receives a welcome bonus of 500 points.

3. Points representing rewards for purchases at Mensa Home stores and on the online store's website will be accumulated in the participant's loyalty card account.

4. For every 10 PLN spent, the participant receives 5 points (1 point is equivalent to 10 grosz for use in future purchases).

5. The participant decides how to use the accumulated points, provided that points will automatically constitute up to 50% of the purchase value.

6. Accumulated points cannot be exchanged for cash.

7. The organizer reserves the right to change the rules of point calculation.

8. Points are granted for purchasing goods from the Mensa Home assortment at the price valid at the time of purchase, excluding any delivery costs.

9. If the goods purchased in the program are returned, the organizer has the right to deduct the equivalent of the points awarded from the participant's account.

10. If the participant withdraws from the contract for the purchase of goods purchased in the program and requests a refund, the organizer has the right to cancel the points awarded to the participant.

11. If the participant receives points as part of a promotion or competition organized by Mensa Home, the organizer may apply additional rules for the awarding and using of points.

12. Points are added to the participant's account immediately after the purchase.

13. The organizer has the right to withdraw points from the participant's account in the case of a negative result of a complaint procedure regarding goods or services purchased in Mensa Home stores.

14. Points will not be awarded for purchasing Mensa Home gift cards.

15. The participant has the right to access their points balance and history via the online store's website or at any brick-and-mortar store.

 

PRIVILEGES

1. Privileges in the program depend on the number of accumulated points.

2. The organizer reserves the right to introduce changes to the privileges, of which participants will be informed on the website www.mensahome.eu.

3. Privileges are valid for a limited time and cannot be extended.

4. Privileges may include discounts, special offers, and other benefits specified in the program's offer.

5. Privileges cannot be transferred to other persons.

6. Privileges in the form of discounts cannot be combined with other discounts, promotions, or special offers, unless the terms of the promotion provide otherwise.

7. The participant receives information about current privileges by email or via the online store's website.

8. Privileges may be granted to participants by Mensa Home partners. Information about these privileges and their rules will be published on the online store's website.

 

PERSONAL DATA

1. The administrator of personal data provided by participants in the program is Trading Company Kowalik K. Kowalik, D. Kowalik General Partnership, headquartered at 22 Słowiańska Street, 64-100 Leszno.

2. Personal data will be processed in accordance with the provisions of the GDPR and the privacy policy available at www.mensahome.eu.

3. Participants' personal data will be used to conduct the program and provide information to participants.

4. Participants' personal data may be disclosed to third parties only within the scope of the program, e.g. for the purpose of delivering rewards or other program benefits.

5. Participants' personal data will be stored for the duration of the program and will be deleted after its completion.

6. Each participant has the right to access and rectify their personal data, as well as the right to withdraw their consent to its processing.

 

FINAL PROVISIONS

1. The organizer reserves the right to modify the terms and conditions of the program and to discontinue the program, subject to a prior 14-day notice to participants.

2. Information about changes to the terms and conditions or the termination of the program will be published on the website www.mensahome.eu.

3. The program participant will not suffer any negative consequences as a result of resigning from participation in the program.

4. The participant agrees to receive information about the program to the email address provided in the registration form.

5. In matters not covered by these terms and conditions, the relevant provisions of Polish law shall apply.

6. These terms and conditions are valid from [date] and are available on the website www.mensahome.eu.

7. These terms and conditions have been translated into English for reference purposes. In case of any discrepancies between the Polish and English versions, the Polish version shall prevail.

By joining the program through the website www.mensahome.eu, the participant confirms that they have read and understood these terms and conditions and agrees to comply with them.
